Media Thresher beta terms

1. Provider and scope

These terms apply to participation in the beta phase of the Mac app Media Thresher. The provider is Heinrich Ventures GmbH, Evereststraße 6, 81825 Munich, Germany (see imprint). By installing or using the beta version, you agree to these terms.

2. Subject of the beta

We provide you with a pre-release version of Media Thresher free of charge. Access is granted on request; there is no entitlement to participate. Participation is voluntary and may be ended by either side at any time without giving reasons.

The beta phase ends when we announce it or when a beta version expires. After that, you may no longer use the beta version; your photos and videos naturally remain untouched.

3. Right of use

For the duration of the beta phase, you receive a simple, non-transferable right, revocable at any time, to use Media Thresher for your own purposes on your Macs. Passing on, publishing, renting, modifying or decompiling the app is not permitted unless mandatory law allows it. Please do not share the download link.

4. Nature of a beta version

A beta version is still under development. It may contain errors, be incomplete or behave differently than described. Features may change or be removed. There is no entitlement to support, to particular features, to updates or to availability. We nevertheless try to fix reported errors.

5. Your data and your backup

Media Thresher can change, move or put files in the trash, for example when cleaning up duplicates, straightening and cropping, assigning places, setting file dates, converting videos and Live Photos, and moving files. Please therefore note:

• Before using the app, make a current, complete backup of your photos and videos, for example with Time Machine, and keep it up to date during the beta.
• Check suggestions before you confirm them, and try new features on a few files first. This applies in particular to features marked “Beta”.
• Only empty trashes once you have checked the result. Media Thresher puts discarded files in the trash of their location or in “Recently Deleted” in Photos; files are only deleted for good after your explicit confirmation.

6. Feedback

Your feedback is voluntary and very helpful to us. By sending feedback, suggestions or screenshots, you grant us the free, non-exclusive right, unlimited in time and territory, to use the content to improve and develop Media Thresher. No remuneration or attribution is provided for this. We do not publish personal content or attachments; how we process them is described in the privacy policy.

7. Liability

As we provide the beta version free of charge, we are only liable for intent and gross negligence. We are only liable for defects in the beta version if we fraudulently concealed them.

These limitations do not apply to damages arising from injury to life, body or health, to claims under the German Product Liability Act and, where we have given a guarantee, to claims arising from it.

In the event of data loss, we are only liable for the effort that would have been required for recovery if you had made regular backups appropriate to the risk (see section 5).

8. Data protection

Media Thresher analyses your photos and videos exclusively on your Mac and does not transfer them to us. Details, including on the beta programme and the video calls, can be found in our privacy policy.

9. Changes

We may adapt these terms for future beta versions. We will inform you of material changes by email. If you then use a new beta version, the amended terms apply.

10. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory provisions of the country in which you have your habitual residence remain unaffected. If you are a merchant, the place of jurisdiction is Munich.

Should any provision be invalid, the validity of the remaining provisions remains unaffected.
